1. Introduction
Welcome to TheMasterAthlete (“TheMasterAthlete”, “we”, “our” or “us”).
These Terms & Conditions (“Terms”) govern your access to and use of TheMasterAthlete website, mobile applications, software, coaching tools, artificial intelligence (“AI”) services and all related products and services (collectively referred to as the Platform).
By creating an account, subscribing to our services, accessing the Platform or using any feature provided by TheMasterAthlete, you agree to be legally bound by these Terms.
If you do not agree to these Terms, you must not access or use the Platform.
These Terms apply to all users of the Platform, including but not limited to:
- Visitors
- Registered athletes
- Coaches
- Clubs
- Teams
- Event organisers
- National governing bodies
- Training groups
- Subscribers
- Commercial partners
Additional terms may apply to certain services, competitions, coaching programmes or commercial partnerships.
2. Definitions
For the purposes of these Terms:
Account means a registered user profile on the Platform.
AI Services means any artificial intelligence, machine learning or automated recommendation tools provided by TheMasterAthlete.
Athlete means any individual using the Platform for training, performance analysis, competition, coaching or community purposes.
Coach means a registered individual providing coaching, mentoring or performance guidance through the Platform.
Content includes text, images, videos, photographs, comments, training programmes, rankings, statistics, competition results, articles, audio recordings, software, graphics and all other material available through the Platform.
Organisation includes athletics clubs, governing bodies, event organisers, competition organisers, schools, universities and commercial partners.
Personal Data has the meaning given under applicable data protection legislation.
Platform means all websites, mobile applications, APIs, software, AI systems and online services operated by TheMasterAthlete.
Services means all products and functionality made available through the Platform.
Subscription means any paid membership or recurring payment arrangement offered by TheMasterAthlete.
User means any individual or organisation accessing or using the Platform.
3. Acceptance of These Terms
By accessing or using the Platform you confirm that:
- You have read these Terms.
- You understand these Terms.
- You agree to comply with these Terms.
- You are legally capable of entering into a binding agreement.
- Any information you provide is accurate and complete.
If you are using the Platform on behalf of an organisation, club or company, you confirm that you have authority to bind that organisation to these Terms.
4. Eligibility
You must be at least 18 years old to create an independent account unless local law permits otherwise.
Users under the age of 18 may only use the Platform where:
- a parent or legal guardian has provided the necessary consent; and
- any applicable safeguarding requirements have been satisfied.
Coaches are responsible for ensuring they comply with all safeguarding, child protection and legal obligations applicable within their jurisdiction.
TheMasterAthlete reserves the right to request proof of age where reasonably necessary.
5. User Accounts
To access certain Services you must create an account.
You agree to:
- provide accurate information;
- keep your information up to date;
- maintain the confidentiality of your login credentials;
- notify us immediately of any unauthorised access to your account;
- accept responsibility for all activity carried out using your account.
You must not:
- create multiple accounts for deceptive purposes;
- impersonate another individual or organisation;
- sell or transfer your account;
- share your login credentials with another person;
- attempt to gain unauthorised access to another user’s account.
We reserve the right to suspend, restrict or terminate any account where we reasonably believe these Terms have been breached or where continued access may compromise the security or integrity of the Platform.
6. Types of Accounts
Depending on the Services available, the Platform may offer different account types, including:
Athlete Accounts
Athlete accounts enable users to:
- create a personal profile;
- record training activities;
- manage performance data;
- receive AI-assisted training recommendations;
- communicate with coaches;
- participate in community features;
- enter competitions or events where supported.
Coach Accounts
Coach accounts may allow users to:
- manage athlete groups;
- create and distribute training programmes;
- review athlete progress;
- communicate with athletes;
- use AI-assisted coaching tools;
- manage coaching services offered through the Platform.
Coach accounts may be subject to additional verification requirements and separate Coach Terms where applicable.
Organisation Accounts
Organisation accounts may be available for clubs, governing bodies, event organisers and commercial partners.
Additional agreements may apply before Organisation accounts are activated.
7. Future Services
TheMasterAthlete continually develops new features.
We may introduce additional Services including, but not limited to:
- wearable device integrations;
- competition registration;
- coaching marketplaces;
- athlete assessments;
- biomechanics analysis;
- video coaching;
- training camp management;
- nutrition tools;
- injury management tools;
- performance benchmarking;
- AI assistants;
- club management systems;
- federation services.
Where new Services are introduced, these Terms will continue to apply unless additional terms are published.
8. AI Services and Training Recommendations
TheMasterAthlete may provide artificial intelligence (“AI”) features designed to assist athletes, coaches and organisations.
These features may include, but are not limited to:
- personalised training plans;
- suggested training sessions;
- performance analysis;
- race predictions;
- pacing recommendations;
- recovery guidance;
- workload monitoring;
- competition preparation;
- coaching assistance;
- technique analysis;
- training insights;
- educational content.
AI-generated content is provided for informational and educational purposes only.
The AI does not replace the judgement of a qualified coach, sports scientist, physiotherapist, physician or other appropriately qualified professional.
Users acknowledge that AI-generated recommendations are based solely on the information available to the Platform and may not reflect all relevant circumstances affecting an individual’s health, fitness, experience or training environment.
TheMasterAthlete does not guarantee that any recommendation will improve performance, prevent injury or achieve a particular sporting outcome.
Users remain solely responsible for deciding whether to follow any recommendation provided by the Platform.
9. Training Plans and Performance Recommendations
Training plans available through the Platform may be:
- generated by AI;
- created by coaches;
- created by organisations;
- created by athletes themselves;
- adapted over time using user feedback or performance data.
Training recommendations should always be interpreted in the context of the user’s:
- age;
- training history;
- current fitness;
- medical history;
- injuries;
- environmental conditions;
- competition schedule;
- recovery status.
No training plan can account for every factor affecting athletic performance.
Users should modify or discontinue training where pain, illness, injury or other medical concerns arise.
TheMasterAthlete accepts no responsibility for injuries, illnesses or losses resulting from the implementation of any training programme.
10. Medical and Safety Disclaimer
TheMasterAthlete is not a medical service.
Nothing on the Platform constitutes:
- medical advice;
- healthcare advice;
- diagnosis;
- treatment;
- physiotherapy;
- rehabilitation;
- nutritional counselling;
- psychological therapy;
- emergency assistance.
Users should seek advice from an appropriately qualified healthcare professional before beginning any exercise programme or making significant changes to existing training.
Users must stop exercising immediately and seek appropriate medical advice if they experience symptoms including, but not limited to:
- chest pain;
- dizziness;
- fainting;
- severe shortness of breath;
- loss of balance;
- sudden weakness;
- severe joint or muscle pain;
- any symptom that causes concern.
Users with existing medical conditions, recent injuries or underlying health concerns should obtain appropriate medical clearance before relying upon any training recommendations provided through the Platform.
11. Athlete Responsibilities
Athletes using the Platform agree to:
- provide accurate information where requested;
- update their profile where relevant;
- train responsibly;
- monitor their own health and wellbeing;
- exercise appropriate judgement when following recommendations;
- ensure they are medically fit to participate in sport;
- comply with applicable competition rules;
- respect other members of the community.
Athletes acknowledge that participation in athletics and other sports carries an inherent risk of injury.
They accept full responsibility for decisions made during training and competition.
12. Coach Responsibilities
Coaches remain solely responsible for all coaching advice they provide through the Platform.
TheMasterAthlete provides technology to facilitate coaching but does not supervise, endorse or verify coaching decisions unless explicitly stated.
Coaches agree that they will:
- act professionally;
- comply with applicable safeguarding legislation;
- comply with all relevant coaching qualifications or licensing requirements within their jurisdiction;
- provide accurate information about their experience and qualifications;
- maintain appropriate professional standards;
- respect athlete confidentiality;
- avoid abusive or discriminatory behaviour.
Where coaches use AI-assisted coaching tools, they acknowledge that AI recommendations should support—not replace—their own professional judgement.
TheMasterAthlete is not responsible for advice exchanged directly between athletes and coaches.
13. Performance Predictions
The Platform may provide estimates, projections or predictions relating to:
- race times;
- performance improvements;
- training readiness;
- injury risk;
- recovery;
- rankings;
- qualification standards;
- competition outcomes.
These predictions are probabilistic estimates generated from available information.
They are not guarantees.
Athletic performance is influenced by numerous variables outside the control of TheMasterAthlete, including illness, injury, weather, competition conditions, equipment, psychology, nutrition and recovery.
Users acknowledge that predictions may be inaccurate.
TheMasterAthlete accepts no liability where predicted outcomes differ from actual performance.
14. Wearable Devices and Third-Party Data
The Platform may integrate with third-party services including wearable devices, fitness trackers and health platforms.
Examples may include:
- Garmin;
- COROS;
- Polar;
- Suunto;
- Apple Health;
- Google Health Connect;
- Strava;
- TrainingPeaks;
- other compatible services.
TheMasterAthlete cannot guarantee the completeness, availability or accuracy of data supplied by third-party providers.
Users remain responsible for reviewing imported data before relying upon it.
Third-party integrations may change or become unavailable without notice.
15. User Acknowledgement
By using the Platform, each user confirms that they understand and accept that:
- sporting activity involves inherent risks;
- no training programme can eliminate the possibility of injury;
- AI recommendations are informational rather than medical advice;
- coaches remain responsible for their own coaching decisions;
- athletes remain responsible for decisions relating to their own training and competition;
- performance improvements cannot be guaranteed;
- success in competition depends upon numerous factors outside the control of TheMasterAthlete.
16. Community Standards and Acceptable Use
TheMasterAthlete aims to provide a safe, respectful and inclusive environment for athletes, coaches, clubs, organisations and supporters.
By using the Platform you agree to interact with others in a respectful, lawful and responsible manner.
You must not:
- harass, intimidate or threaten another user;
- publish defamatory, abusive or discriminatory content;
- promote violence, hatred or illegal activities;
- impersonate another individual or organisation;
- upload malicious software or harmful code;
- interfere with the operation or security of the Platform;
- attempt to gain unauthorised access to systems or user accounts;
- use automated software, bots or scraping tools without our prior written permission;
- misuse messaging or community features for spam or unsolicited marketing;
- publish content that infringes another person’s intellectual property rights.
We reserve the right to remove content or suspend accounts where we reasonably believe these standards have been breached.
17. User Content
Users may upload or publish content including:
- training sessions;
- photographs;
- videos;
- coaching notes;
- competition reports;
- comments;
- forum posts;
- articles;
- performance data;
- race results;
- documents;
- other materials.
You retain ownership of content you create.
However, by uploading content you grant TheMasterAthlete a worldwide, non-exclusive, royalty-free licence to:
- host;
- store;
- display;
- reproduce;
- distribute;
- adapt;
- format;
- publish;
that content solely for the purpose of operating, improving and promoting the Platform.
You confirm that:
- you own the content or have permission to publish it;
- publication does not infringe another person’s rights;
- the content is accurate to the best of your knowledge.
You remain responsible for all content you upload.
18. Athlete Profiles and Performance Data
The Platform allows athletes to maintain personal performance records.
These may include:
- personal bests;
- training history;
- competition results;
- rankings;
- goals;
- achievements;
- coaching history;
- statistics;
- performance trends.
Users remain responsible for ensuring information they provide is accurate.
Competition results obtained from recognised governing bodies or publicly available competition sources may be displayed within athlete profiles where permitted by law.
Athletes may request correction of inaccurate personal information in accordance with our Privacy Policy.
19. Clubs, Teams and Organisations
The Platform may allow organisations to:
- create organisation profiles;
- manage members;
- administer coaches;
- organise training groups;
- publish events;
- analyse participation;
- communicate with members.
Organisation administrators are responsible for ensuring they have authority to manage information submitted through organisational accounts.
TheMasterAthlete does not verify the legal authority of organisation administrators unless expressly stated.
20. Intellectual Property
Unless otherwise stated, all intellectual property rights relating to the Platform are owned by or licensed to TheMasterAthlete.
This includes:
- software;
- databases;
- algorithms;
- AI models;
- graphics;
- logos;
- branding;
- articles;
- videos;
- podcasts;
- training resources;
- reports;
- documentation;
- user interface designs.
No part of the Platform may be copied, reproduced, distributed, modified, reverse engineered or commercially exploited without our prior written permission except where permitted by law.
Nothing within these Terms transfers ownership of our intellectual property to any user.
21. Data Ownership
Users retain ownership of the personal information and original content they submit to the Platform.
TheMasterAthlete owns:
- software;
- databases;
- analytics;
- aggregated datasets;
- AI models;
- system-generated insights;
- anonymised statistics;
- benchmarking methodologies;
- platform design.
Where data has been anonymised so that individuals cannot reasonably be identified, TheMasterAthlete may use that information to:
- improve the Platform;
- develop AI models;
- produce research;
- generate statistical reports;
- improve training recommendations;
- support academic or sporting research.
No personally identifiable information will be included in published research without appropriate consent.
22. Copyright Complaints
If you believe content published on the Platform infringes your intellectual property rights, please contact us with:
- your contact details;
- identification of the copyrighted work;
- the location of the allegedly infringing material;
- evidence supporting your claim.
We will investigate complaints promptly and may remove material where appropriate.
23. Anti-Doping and Fair Competition
TheMasterAthlete supports clean sport.
Users are responsible for complying with the anti-doping rules applicable to their sport and governing body.
Nothing within the Platform should be interpreted as encouraging prohibited performance-enhancing practices.
TheMasterAthlete accepts no responsibility for decisions made by athletes regarding supplements, medications or substances.
Users should always verify the status of any substance with the relevant anti-doping authority before use.
24. Safeguarding
Users working with children or vulnerable adults must comply with all safeguarding legislation and guidance applicable within their jurisdiction.
Coaches, clubs and organisations remain responsible for ensuring appropriate safeguarding procedures are followed.
TheMasterAthlete may suspend or terminate accounts where safeguarding concerns are identified.
Where required by law, we may cooperate with regulatory authorities and law enforcement agencies.
25. Subscriptions and Paid Services
TheMasterAthlete may offer free and paid Services.
Paid Services may include, but are not limited to:
- Premium athlete memberships
- Coach subscriptions
- Organisation accounts
- AI coaching features
- Performance analytics
- Training plan libraries
- Education and certification courses
- Event management tools
- Marketplace services
- Digital products
Subscription details, pricing and included features will be displayed before purchase.
All prices will be shown in the applicable currency and, where required by law, will include any applicable taxes.
26. Payments
Payments may be processed through authorised third-party payment providers.
TheMasterAthlete does not store complete payment card details.
By purchasing a subscription you authorise the applicable payment provider to collect payment in accordance with your chosen subscription plan.
You agree to provide accurate payment information and to keep that information up to date.
Failure to successfully process payment may result in suspension or cancellation of paid Services.
27. Subscription Renewals
Unless otherwise stated, subscriptions renew automatically at the end of each billing period.
You may cancel automatic renewal at any time through your account settings.
Cancellation will normally take effect at the end of the current paid billing period unless applicable law provides otherwise.
No partial refunds are provided for unused subscription periods unless required by law or expressly stated in our Refund Policy.
28. Refund Policy
Digital products and subscriptions may be subject to separate refund terms.
Where refunds are available, they will be processed in accordance with our published Refund Policy.
Nothing in these Terms limits any statutory consumer rights available under applicable law.
29. Availability of Services
We aim to keep the Platform available at all times.
However, we do not guarantee uninterrupted access.
The Platform may occasionally be unavailable due to:
- maintenance;
- software updates;
- security improvements;
- technical failures;
- internet disruptions;
- third-party service outages;
- events beyond our reasonable control.
We may modify, suspend or discontinue any feature where reasonably necessary.
Where practical, we will provide advance notice of significant planned maintenance.
30. Third-Party Services
The Platform may integrate with third-party services including payment providers, wearable devices, competition platforms, mapping services, video platforms and analytics providers.
TheMasterAthlete does not control these third-party services and accepts no responsibility for:
- their availability;
- their accuracy;
- their security;
- changes to their functionality;
- their terms or privacy practices.
Use of third-party services is subject to the terms of those providers.
31. Limitation of Liability
To the fullest extent permitted by law, TheMasterAthlete shall not be liable for any direct, indirect, incidental, consequential, special or punitive loss or damage arising from or connected with:
- use of the Platform;
- inability to access the Platform;
- reliance upon AI-generated recommendations;
- reliance upon coaching advice;
- training programmes;
- performance predictions;
- competition results;
- user-generated content;
- third-party services;
- loss of data;
- loss of profits;
- business interruption;
- reputational damage.
Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence where such liability cannot legally be excluded;
- fraud or fraudulent misrepresentation;
- any liability that cannot lawfully be excluded.
Where liability cannot be excluded, our total aggregate liability shall, to the fullest extent permitted by law, be limited to the amount paid by the user to TheMasterAthlete during the twelve (12) months immediately preceding the event giving rise to the claim.
32. Indemnity
You agree to indemnify and hold harmless TheMasterAthlete, its directors, employees, contractors and partners against claims, losses, liabilities, damages, costs and expenses arising from:
- your breach of these Terms;
- misuse of the Platform;
- unlawful conduct;
- infringement of another person’s rights;
- content you upload;
- coaching services you provide;
- activities carried out through your account.
33. Suspension and Termination
We may suspend or terminate access to the Platform where we reasonably believe:
- these Terms have been breached;
- fraudulent activity has occurred;
- illegal activity is suspected;
- user behaviour presents a safeguarding risk;
- continued access may compromise the security or integrity of the Platform.
Users may close their account at any time through the Platform or by contacting us.
Termination does not affect rights or obligations that arose before termination.
Certain provisions of these Terms, including those relating to intellectual property, liability, indemnity and dispute resolution, will continue to apply after termination.
34. Changes to the Platform
We continually improve our Services.
We may:
- introduce new features;
- remove obsolete functionality;
- update pricing;
- modify AI capabilities;
- improve security;
- redesign user interfaces.
Where changes materially affect users, we will provide reasonable notice where practicable.
35. Changes to These Terms
We may update these Terms from time to time.
Where changes are significant, we will notify registered users using appropriate methods, which may include email or notifications within the Platform.
Continued use of the Platform following publication of revised Terms constitutes acceptance of those revised Terms.
36. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of England and Wales unless mandatory local consumer protection laws require otherwise.
Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer legislation provides otherwise.
37. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions shall continue in full force and effect.
38. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, Medical Disclaimer, AI Disclaimer, Refund Policy and any additional policies expressly incorporated by reference, constitute the entire agreement between you and TheMasterAthlete relating to your use of the Platform.
